Title 11 Regulation of Building and Land Use

Chapter 11.12 Fences

Section 11.12.040 Swimming Pool.
  1. For the purposes of this section, a "swimming pool" is a swimming pool, spa, wading pool, or other impoundment of water exceeding five thousand gallons and eighteen inches or more in depth, excluding ponds, lakes, streams, rivers and decorative fountains.
  2. No person may maintain a swimming pool unless it is completely surrounded by a fence, wall, building, or other enclosure at least four feet above grade and built as to prevent crawling beneath, approved by the building inspector, by which the pool is inaccessible by small children.
  3. If the enclosure be a woven wire fence, the pattern and type must discourage climbing.
  4. If the enclosure be a wooden fence, it must be built with vertical members so as to discourage climbing.
  5. No opening, except a door or gate, can exceed four inches in any dimension.
  6. Any door or gate in the pool enclosure, except when part of the dwelling building, must have self-closing and self-locking equipment by which the door or gate is kept secure when not in use. Any lock release on the outside of the door or gate must be at least forty inches above the ground.
